PRIVACY POLICY of the Measurme Platform

This Privacy Policy explains how Measurme collects, uses, transfers, protects, and stores your personal data that it obtains when you use the Platform or that you may provide directly to Measurme, as well as the rights you have as a personal data subject.

Measurme is a technology platform that facilitates interaction between Clients and Professionals, helps Clients find suitable Professionals, and helps Professionals organize their work with Clients, maintain professional records, use psychological questionnaires, analytical tools, AI Features, and other Platform capabilities.

Measurme does not sell your personal data. Measurme processes it only to the extent necessary for the operation of the Platform, interaction between Clients and Professionals, security, compliance with legal requirements, improvement of functionality, and the other purposes set out in this Policy.

Please read the information below for further details.

1. GENERAL PROVISIONS

1.1. This Privacy Policy (hereinafter, the Policy) defines the procedure for collecting, using, storing, transferring, protecting, and otherwise processing personal data when using the Measurme platform, including the website, web application, personal account, marketplace, analytical tools, AI Features, services, and other information technology solutions owned or administered by Measurme (hereinafter collectively, the Platform).

1.2. The Platform is owned and administered by individual entrepreneur Pavlo Volodymyrovych Plazo, located at: 20 Dzherelna Street, Busk, Zolochiv District, Lviv Region, 80500, Ukraine; email for personal data inquiries: support@measurme.com (hereinafter, Measurme or we).

1.3. Depending on the nature of the personal data processing, Measurme may perform different roles under applicable law.

1.3.1. Measurme acts as the owner (controller) of personal data where it independently determines the purposes and means of processing, including in relation to the creation and administration of User Accounts and Profiles, operation of the Platform, arrangement of payments, provision of technical support, information security, analytics, marketing communications, and other processes related to the operation of the Platform.

1.3.2. If a Professional uses the Platform to maintain professional records concerning their Clients, Measurme may provide only the technical operation of the relevant service and process such personal data solely to the extent necessary to provide the Platform’s functionality.

1.3.3. The Professional independently determines the purpose, scope, content, and legal grounds for processing their Clients’ personal data and is responsible for complying with applicable law when processing such data.

1.3.4. The rights and obligations of Measurme, Professionals, and Users regarding the processing of personal data are governed by this Policy, the User Agreement, and applicable law.

1.4. The Policy applies to all persons who use or interact with the Platform, including:

1.4.1. website visitors;

1.4.2. Clients and other persons who search for Professionals, book consultations, or use Professionals’ services through the Platform;

1.4.3. psychologists, psychotherapists, psychiatrists, coaches, and other professionals who create a profile on the Platform or use its functionality;

1.4.4. persons who contact customer support, submit applications, inquiries, or reviews, or otherwise interact with Measurme.

1.5. This Policy is an integral part of the Measurme User Agreement (hereinafter, the Agreement). Terms not defined in this Policy have the meanings given in the User Agreement.

1.6. Any reference to this Policy in the Agreement means that all provisions of the Policy form an integral part of the Agreement and apply to the processing of any personal data transferred to Measurme in the course of performing the Agreement.

1.7. The Policy applies to personal data processing carried out by Measurme after it takes effect, as well as to personal data previously provided to Measurme to the extent that such personal data continues to be processed after this Policy takes effect.

1.8. Measurme provides permanent and unrestricted access to this Policy by publishing it on the Platform.

1.9. Personal data is processed in accordance with the Law of Ukraine “On Personal Data Protection,” other applicable laws of Ukraine, and, where applicable, the requirements of the EU General Data Protection Regulation (GDPR).

1.10. By using the Platform, creating an Account, providing your personal data, and confirming your acceptance of this Policy by checking the relevant box or taking another clear affirmative action provided by the Platform’s functionality, you confirm that you have read this Policy, understand its contents, accept its terms, and, where required by law, this Policy, or the User Agreement, consent to the relevant processing of personal data.

1.11. Where special categories of personal data are processed while using the Platform, such processing is carried out only where an appropriate legal basis under applicable law exists, including the explicit consent of the personal data subject where such consent is required, or another appropriate legal basis.

1.12. If a Professional enters their Clients’ personal data or special categories of personal data into the Platform, the Professional confirms that they have appropriate legal grounds for collecting, entering into the Platform, processing, and using the Platform’s functionality in relation to such data in accordance with applicable law, and that they have fulfilled all obligations to inform the personal data subject where such obligations are imposed on them by law. Measurme does not verify the existence of such legal grounds in each individual case unless otherwise expressly required by law or the Platform’s functionality.

1.13. Consent to personal data processing, where required by law, this Policy, or the User Agreement, is provided for the purpose of:

  • ensuring the operation of the Platform;
  • creating and administering an Account;
  • facilitating interaction between a Client and a Professional;
  • enabling a Professional to provide the relevant professional services;
  • using the Platform’s functionality, including maintaining professional records, psychological questionnaires, analytical tools, AI Features, and other Platform services;
  • complying with legal requirements;
  • ensuring the information security of the Platform and preventing fraud, abuse, and unauthorized use of the Platform;
  • achieving the other purposes set out in this Policy and the User Agreement.

1.14. Consent to personal data processing does not mean that Measurme is an entity that provides psychological, psychotherapeutic, psychiatric, or other medical services. Measurme does not conduct psychological, psychotherapeutic, psychiatric, medical, or other professional activities subject to licensing or special regulation and is not responsible for the content, quality, safety, legality, results, or consequences of services provided by Professionals.

1.15. The Platform’s AI Features are used in accordance with the terms set out in Section 13 of this Policy.

1.16. If you disagree with this Policy or any of its terms, or do not wish to provide the personal data necessary to use the Platform, please do not use the Platform. In such a case, use of the Platform or certain of its features may be impossible.

2. DEFINITIONS

2.1. Personal data means any information concerning an identified individual or an individual who can be directly or indirectly identified, within the meaning of applicable personal data protection law.

2.2. Special categories of personal data means personal data that falls within special categories under applicable law, including, without limitation, data concerning a person’s physical or mental health, the results of psychological tests and questionnaires, psychotherapy records, psychiatric opinions, information about treatment, prescribed medications, and other sensitive personal data.

2.3. User means any individual who uses the Platform, regardless of the scope of functionality available to them. For the purposes of this Policy, Users include Clients and Professionals.

2.4. Client means a User who uses the Platform to search for a Professional, book consultations, receive a Professional’s services, use related Platform functionality, or otherwise interact with a Professional.

2.5. Professional means a User who uses the Platform to publish information about themselves, organize their professional activities, and/or provide services to their Clients. Professionals may include psychologists, psychotherapists, psychiatrists, coaches, and other specialists for whom the Platform’s functionality provides the ability to create a professional Profile.

2.6. Account means the set of technical data that enables a User’s registration, authentication, and access to the Platform, including login credentials, password (in encrypted form), security settings, login history, and other technical data necessary to use the Platform.

2.7. Profile means the set of personal and other information about a User placed in their Account and used to identify the User, interact with other Users, use the Platform’s functionality, and, in the case of a Professional, publish information about their professional activities.

2.8. AI Features means the Platform functionality that uses artificial intelligence technologies, including third-party AI services or models, to analyze, summarize, structure, prepare supporting information, or automatically process data entered into the Platform.

2.9. Cookies means cookies and other similar technologies that may be stored on a User’s device or used during the operation of the Platform to ensure its proper functioning, perform analytics, retain settings, personalize content, enhance security, or achieve other purposes set out in this Policy.

2.10. Processing of personal data means any action or set of actions performed on personal data, with or without automated means, including collection, recording, systematization, accumulation, storage, adaptation, alteration, use, consultation, transfer, dissemination, provision of access, restriction, erasure, destruction, or other operations involving personal data.

3. PERSONAL DATA WE PROCESS

Measurme processes only the personal data necessary to operate the Platform, create and administer User Accounts and Profiles, facilitate interaction between Clients and Professionals, perform the User Agreement, comply with legal requirements, and achieve the other purposes set out in this Policy.

3.1. Data you provide to us

3.1.1. Creating a Client Account

When a Client registers, Measurme may process, in particular:

  • first and last name;
  • telephone number;
  • email address;
  • password (in encrypted form);
  • other data necessary to create an Account.

This data is used to register and authenticate the User, provide access to the Platform, administer the Account, ensure information security, and perform the User Agreement.

3.1.2. Client Profile

After creating an Account, a Client may add the following information to their Profile:

  • date of birth or age;
  • gender;
  • country of residence;
  • profile photo;
  • preferred language of communication;
  • other information that the Client voluntarily chooses to include in their Profile.

3.1.3. Creating a Professional Account and Profile

When a Professional registers and uses the Platform, Measurme may process, in particular:

  • first name, last name, and patronymic, if applicable;
  • telephone number;
  • email address;
  • password (in encrypted form);
  • profile photo;
  • country, city, and time zone;
  • consultation languages;
  • education information;
  • professional training;
  • diplomas;
  • certificates;
  • professional qualification information;
  • specialization;
  • work experience;
  • professional approaches;
  • areas of practice;
  • consultation fees;
  • work schedule;
  • information about availability for consultations;
  • payment, tax, and other data necessary to make payments, maintain accounting records, and comply with legal requirements;
  • other information that the Professional voluntarily places in their Profile.

Measurme has the right to verify the accuracy of information provided by a Professional by requesting additional documents, using information from open government, professional, or other public registers, and using other methods of verification not prohibited by law.

3.1.4. Client data that may be entered by a Professional

When using CRM functionality and other Platform services, a Professional may enter personal data concerning their Clients that is necessary for their professional activities. Such data may include, in particular:

  • professional records;
  • consultation history;
  • results of psychological tests;
  • results of psychological questionnaires;
  • assessments;
  • opinions;
  • documents;
  • files;
  • information about treatment, prescribed medications, or other prescriptions made by the Professional, if applicable;
  • special categories of personal data;
  • other information entered by the Professional while using the Platform’s functionality in connection with their professional activities.

The scope of such data is determined exclusively by the Professional, depending on the nature of their professional activities.

3.1.5. Personal data of other persons that you provide to Measurme

When using the Platform, you may provide Measurme with personal data of other persons, including where:

  • a Professional enters the personal data of their Client;
  • you act as the legal representative of another person;
  • you act in another person’s interests or on their instructions;
  • you provide another person’s contact details;
  • you upload documents containing third-party personal data;
  • you otherwise transfer the personal data of other persons through the Platform.

In such a case, you confirm that you have appropriate legal grounds for transferring such personal data and that you have fulfilled your obligations to inform the relevant persons, where required by law.

3.1.6. Communications and inquiries

When you interact with Measurme, we may process:

  • customer support inquiries;
  • messages;
  • requests;
  • complaints;
  • reviews;
  • ratings;
  • survey responses;
  • documents or files you send;
  • records of communications with customer support, where such recording is provided by the Platform’s functionality or by law.

3.2. Data collected automatically

3.2.1. Platform usage data

When you use the Platform, Measurme may automatically generate and process information about your use of its functionality, including:

  • Account login history;
  • history of Platform functionality use;
  • consultation booking history;
  • history of CRM functionality use;
  • history of AI Features use;
  • history of use of psychological tests, questionnaires, and other Platform tools;
  • information about interactions between a Client and a Professional;
  • information about payments made;
  • event logs;
  • other information generated when using the Platform.

Such data is used to operate the Platform, resolve technical errors, improve functionality, ensure information security, and prevent fraud.

3.2.2. Technical data

The following may be processed automatically:

  • IP address;
  • device type and model;
  • operating system;
  • browser;
  • application version;
  • language;
  • time zone;
  • date and time of Platform use;
  • event logs;
  • technical device identifiers;
  • other technical data necessary to operate the Platform.

3.3. Cookies and similar technologies

Measurme uses cookies and other similar technologies to ensure the proper operation of the Platform, retain User settings, perform analytics, ensure information security, improve the user experience, and, where consent has been provided, for marketing purposes.

Measurme may use the following categories of cookies:

  • essential cookies — necessary for Platform operation, authorization, security, and retention of settings;
  • analytics cookies — help us understand how Users interact with the Platform, which pages they view, and which features they use;
  • functional cookies — enable User settings to be remembered;
  • marketing cookies — may be used to personalize advertising or measure the effectiveness of marketing campaigns where the User has given consent.

Measurme may use third-party analytics services, including:

  • web analytics services, including Google Analytics, which may collect information about website usage, including the pages a User visits, time spent on the website, device, browser, and other technical data;
  • user behavior analytics services, including Hotjar, to analyze user behavior on the website, including heatmaps, session recordings, surveys, or other user experience research tools.

A User can manage cookies through their browser settings or the relevant consent banner or consent management tool, if available on the website. Disabling certain categories of cookies may cause some Platform features to function incorrectly.

3.4. Personal data received by Measurme from other persons and services

To operate the Platform, Measurme may receive certain categories of personal data from other persons or services rather than directly from a User where this is necessary for the Platform’s operation or provided for by law. Such sources may include:

  • payment providers;
  • authentication or electronic identification service providers;
  • government, professional, or other public registers;
  • other Platform Users;
  • other persons or services where receipt of such data is provided for by the Platform’s functionality, the User Agreement, or law.

3.5. Children’s data

The Platform is not intended for independent use by persons under the age of 18 unless otherwise expressly provided by the Platform’s functionality, separate terms, or law.

Where minors’ personal data is processed in connection with a Professional’s provision of professional services, such processing is carried out by the relevant Professional on an appropriate legal basis and in accordance with applicable law.

If Measurme becomes aware that a minor’s personal data has been provided without the appropriate consent of their legal representative, we may delete such data or take other necessary measures.

3.6. Data that Measurme does not collect

Measurme does not collect personal data that is not necessary to operate the Platform or achieve the purposes set out in this Policy.

Measurme does not secretly collect personal data from Users’ devices, access information for which access was not granted by the User or provided by the Platform’s functionality, or process personal data beyond the purposes set out in this Policy and applicable law.

4. CONFIDENTIALITY IN INTERACTIONS BETWEEN CLIENTS AND PROFESSIONALS

4.1. Professionals who access Clients’ personal data through the Platform must:

4.1.1. use such data exclusively to work with the relevant Client;

4.1.2. not disclose personal data to third parties without an appropriate legal basis;

4.1.3. not use Clients’ personal data for their own marketing or other purposes unrelated to providing services to the Client unless the Client has given the relevant consent;

4.1.4. comply with personal data protection laws;

4.1.5. take appropriate measures to protect personal data against loss, unauthorized access, disclosure, or misuse.

4.2. Clients must not transfer third parties’ personal data through the Platform without an appropriate legal basis.

4.3. Measurme is not responsible for a Professional’s unlawful processing of personal data outside the Platform where such processing was not carried out on Measurme’s instructions or caused by Measurme’s actions.

5. PERSONAL DATA PROCESSING PROCEDURE

5.1. Measurme processes personal data using automated and, where necessary, non-automated means in accordance with applicable law.

5.2. Personal data processing may include, in particular, collection, registration, systematization, accumulation, storage, clarification (updating or alteration), use, transfer, provision of access, restriction, erasure, destruction, and other actions necessary to operate the Platform.

5.3. Measurme processes personal data using modern information and communication technologies, server infrastructure, cloud services, backup facilities, event logging, and other technical solutions necessary to ensure the proper operation of the Platform.

5.4. Personal data may be processed only by employees, authorized persons, contractors, or service providers who need access to such data to perform their functions and who are required to comply with confidentiality and personal data protection requirements.

5.5. Measurme applies organizational and technical measures designed to ensure the confidentiality, integrity, availability, and protection of personal data against accidental or unlawful destruction, loss, alteration, unauthorized access, disclosure, or other unlawful processing.

6. PURPOSES OF PERSONAL DATA PROCESSING

6.1. Measurme processes personal data only to the extent necessary to achieve lawful processing purposes.

6.2. Measurme may process personal data, in particular, for the purpose of:

  • creating, administering, and ensuring the operation of User Accounts and Profiles;
  • providing access to the Platform’s functionality;
  • facilitating interaction between Clients and Professionals;
  • enabling consultations to be booked, conducted, administered, and documented;
  • enabling the use of CRM functionality, professional records, psychological tests, questionnaires, analytical tools, and AI Features;
  • processing payments and maintaining accounting, tax, and other records;
  • verifying information about Professionals;
  • ensuring the information security of the Platform;
  • detecting, preventing, and investigating fraud, misuse of the Platform, or other violations;
  • providing technical support;
  • reviewing User inquiries, applications, claims, and requests;
  • improving the Platform, developing new functionality, and conducting statistical and analytical reviews;
  • complying with legal requirements;
  • protecting the rights, legitimate interests, and safety of Users and Measurme;
  • sending informational and service messages and, where an appropriate legal basis exists, marketing communications.

6.3. Marketing communications are sent only where an appropriate legal basis exists, unless otherwise provided by applicable law.

6.4. A User has the right to opt out of marketing communications at any time by using the relevant Platform functionality or another method specified in the relevant communication.

7. LEGAL BASES FOR PERSONAL DATA PROCESSING

7.1. Measurme processes personal data only where there is an appropriate legal basis under applicable law.

7.2. Depending on the nature of the processing and the category of personal data, the legal basis may be:

  • entering into and performing the User Agreement or other contracts;
  • compliance with legal obligations imposed on Measurme;
  • a legitimate interest of Measurme or a third party, provided that such interest is not overridden by the rights and freedoms of the personal data subject;
  • the consent of the personal data subject where such consent is required by law;
  • other legal bases provided by applicable law.

7.3. For certain categories of personal data, including special categories of personal data, Measurme ensures that additional legal grounds for processing exist where required by applicable law.

8. TRANSFER OF PERSONAL DATA

8.1. Measurme does not sell Users’ personal data or transfer it to third parties except as provided in this Policy, the User Agreement, or applicable law.

8.2. Measurme may transfer personal data only to the extent necessary to achieve the relevant processing purpose.

8.3. Personal data may be transferred, in particular, to:

  • the relevant Professional, to the extent necessary for them to provide professional services to the Client;
  • the relevant Client, to the extent necessary to facilitate interaction with the Professional;
  • providers of cloud infrastructure, servers, hosting, and backup services;
  • payment providers and other services necessary to process payments;
  • electronic identification and authentication services;
  • providers of analytical, communication, information technology, and other services necessary to operate the Platform;
  • providers of AI solutions, including Azure AI, Azure OpenAI, or other compatible AI services;
  • video communication providers, including Zoom;
  • analytics providers, including web analytics and user behavior analytics services (such as Google Analytics and Hotjar);
  • government authorities, law enforcement agencies, courts, or other authorized persons where required by law or necessary to protect the rights and interests of Measurme, Users, or third parties;
  • contractors, consultants, IT providers, support services, auditors, accountants, and lawyers;
  • other persons where such transfer is made at your direction or with your consent.

8.4. All persons to whom Measurme transfers personal data receive access only to the personal data necessary to perform their assigned functions.

8.5. Measurme takes reasonable measures to ensure that persons to whom personal data is transferred provide an appropriate level of protection in accordance with applicable law. Service providers that receive access to personal data must process such data only under the relevant instructions or agreements and take appropriate protective measures.

8.6. Where Measurme provides only the technical operation of the Platform for a Professional to work with their Clients’ personal data, Measurme employees may access such data only in the cases specified in this Policy, the User Agreement, and applicable law.

9. INTERNATIONAL TRANSFERS OF PERSONAL DATA

9.1. During the operation of the Platform, certain personal data may be processed or transferred outside Ukraine, including in connection with the use of international cloud services, AI services, payment infrastructure, backup facilities, analytics services, or other technology services.

9.2. When personal data is transferred internationally, Measurme ensures that appropriate personal data safeguards are applied in accordance with applicable law. Such measures may include standard contractual clauses, contractual obligations with providers, technical safeguards, encryption, access restrictions, data minimization, and other appropriate mechanisms.

9.3. Where the GDPR applies to personal data processing, Measurme uses the international data transfer mechanisms it provides, including Standard Contractual Clauses (SCCs), European Commission adequacy decisions, or other mechanisms provided by the GDPR.

10. PERSONAL DATA RETENTION PERIODS

10.1. Measurme retains personal data only for as long as necessary to achieve the purpose of its processing, unless another retention period is provided by law or this Policy.

10.2. The indicative retention periods for certain categories of personal data are:

  • User Account and Profile data: for the life of the Account and, as a rule, for up to 3 (three) years after its deletion, unless another period is required by law or is necessary to protect Measurme’s rights and legitimate interests;
  • personal data contained in a Professional’s records concerning their Clients: while the Professional uses the relevant functionality and, after such use ends, in accordance with the User Agreement or until instructions to delete the data are received from the Professional, unless otherwise required by the Client’s rights or by law;
  • payment, accounting, and tax data: for the periods prescribed by law;
  • customer support inquiries, messages, complaints, and other communications: generally for up to 3 (three) years after the relevant inquiry is concluded;
  • event logs, technical logs, information security data, and audit data: for the period necessary to ensure Platform security, but no longer than 5 (five) years unless otherwise required by law;
  • marketing data: until the relevant consent is withdrawn or marketing communications end;
  • data used for analytics, statistics, and Platform improvement: for the period necessary to achieve the relevant purpose, after which it may be anonymized.

10.3. After the retention period expires, personal data is deleted, de-identified (anonymized), or destroyed unless its continued storage is required by law or necessary to protect the rights and legitimate interests of Measurme, a Professional, or another User.

10.4. Where Measurme processes personal data on behalf of a Professional solely to operate the Platform, its retention periods may also be determined by the agreement between Measurme and the Professional or by the Professional’s instructions, provided that these do not conflict with legal requirements.

10.5. Data that does not enable a person to be directly or indirectly identified may be retained in anonymized form for statistical, analytical, and research purposes and to improve the Platform.

10.6. When a User’s Account is deleted, data may be deleted or anonymized in accordance with the Platform’s functionality, legal requirements, the relevant party’s role in relation to such data, and the need to protect rights and legitimate interests.

11. RIGHTS OF PERSONAL DATA SUBJECTS

11.1. A personal data subject has the rights provided by Ukrainian law and, where applicable, by the GDPR and other personal data protection laws.

11.2. In particular, you have the right to:

  • know the sources from which your personal data is collected, its composition, and the purpose of its processing;
  • obtain information about the processing of your personal data;
  • access your personal data;
  • request the correction of inaccurate or incomplete personal data;
  • request the deletion of personal data where provided by law;
  • request the restriction of personal data processing;
  • object to personal data processing where provided by law;
  • withdraw your consent to personal data processing where the processing is based on that consent;
  • receive your personal data in a structured format where provided by law;
  • lodge a complaint with a competent authority or a court;
  • exercise other rights provided by law.

11.3. To exercise your rights, you may contact Measurme using the contact details in Section 16 of this Policy.

11.4. To protect personal data, Measurme has the right to request information necessary to verify the applicant’s identity.

11.5. Where Measurme processes personal data solely on a Professional’s instructions, a request to exercise a personal data subject’s rights may be forwarded to the relevant Professional for consideration and fulfillment unless otherwise provided by law.

12. PERSONAL DATA PROTECTION

12.1. Measurme takes appropriate organizational, technical, and legal measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, access, or other unlawful processing.

12.2. To protect personal data, Measurme may use, in particular:

  • encryption and secure data transfer protocols while data is transmitted and stored;
  • secure servers and cloud infrastructure;
  • information backups;
  • multi-level access controls;
  • audit logs and information security monitoring;
  • User authentication and authorization tools;
  • restrictions on employee and contractor access;
  • contractual confidentiality obligations;
  • other technical and organizational security measures appropriate to the current state of technological development.

12.3. Access to personal data is granted only to Measurme employees, contractors, or other authorized persons who require such access to perform their functions and who are required to comply with confidentiality obligations.

12.4. Where Measurme provides only the technical operation of the Platform for a Professional to work with their Clients’ personal data, Measurme employees or authorized persons may access such data only where necessary to:

  • provide technical support;
  • resolve technical issues;
  • ensure the information security of the Platform;
  • comply with legal requirements;
  • prevent misuse of the Platform.

12.5. Despite the use of modern security measures, no information transmission or storage system can guarantee absolute protection against all possible information security risks. Measurme does not guarantee the complete absence of unauthorized access where such access results from circumstances beyond its reasonable control.

12.6. If a personal data security breach is identified, Measurme will take the measures required by applicable law, including measures to minimize its possible consequences and to notify competent authorities and personal data subjects where such notification is required by law.

13. AI FEATURES AND AUTOMATED DATA PROCESSING

13.1. Measurme may use AI Features to provide certain Platform capabilities, including information analysis, structuring of professional records, preparation of summaries, statistics, supporting materials, analytical findings, or other functionality available to Users.

13.2. AI Features are used exclusively as supporting information and analytical tools and do not replace a Professional’s assessment, diagnosis, treatment, psychological opinion, medical opinion, or other decisions.

13.3. Any output generated by AI Features is for informational purposes only and must be independently assessed by the relevant Professional before use. Analyses, summaries, recommendations, forecasts, or other materials generated using artificial intelligence technologies do not constitute a medical opinion, diagnosis, treatment prescription, or recommendation regarding the choice of treatment, psychotherapy, or psychiatric care.

13.4. Measurme does not guarantee the completeness, accuracy, currency, or absence of errors in output generated by AI Features.

13.5. Final decisions regarding diagnosis, treatment, psychotherapy, the prescription of medicinal products, or other professional matters are made exclusively by the Professional, who is responsible for such decisions under applicable law and professional standards.

13.6. Measurme does not make automated decisions concerning Clients that produce legal effects or otherwise significantly affect their rights or legitimate interests without human involvement. AI Features do not make automated decisions concerning a Client without the involvement of a Professional.

13.7. To provide AI Features, certain data may be processed using third-party AI services or models in accordance with this Policy and applicable law. Measurme uses AI solutions including Azure AI, Azure OpenAI, or other compatible AI services.

13.8. Measurme recommends that AI Features not be used as the sole source for making decisions concerning diagnosis, treatment, psychotherapy, or other professional actions. Any AI output must be assessed by a Professional in light of the specific circumstances, professional standards, and applicable law.

13.9. Data relating to a specific Client may be used to provide AI Features, including a Professional’s notes, responses to psychological questionnaires, test results, scores, and other information entered into the Platform.

13.10. Measurme does not use User or Client data to train, fine-tune, or improve AI models. Such data is processed only to provide a response to a specific request within the Platform.

13.11. Measurme may use anonymized or aggregated data for statistical and analytical purposes and to improve the Platform. Where personal data must be processed to achieve the relevant purpose, such processing is carried out in accordance with this Policy and applicable law.

13.12. Measurme recommends that Users not include excessive personal data in AI prompts where it is not necessary for the relevant purpose. Measurme may apply technical and organizational measures to minimize the amount of data processed by AI Features.

14. CHANGES TO THIS POLICY

14.1. Measurme has the right to amend or supplement this Policy at any time, including in connection with changes to the law, Platform functionality, personal data processing procedures, or the introduction of new services.

14.2. The current version of the Policy is always published on the Platform together with its effective date.

14.3. If changes materially affect Users’ rights or the personal data processing procedure, Measurme may additionally notify Users by publishing a notice on the Platform, sending a notice by email or through the personal account, or using another available method.

14.4. Continued use of the Platform after a new version of the Policy takes effect confirms that the User has read and accepted the new version unless otherwise provided by applicable law.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1. This Policy is governed by the laws of Ukraine unless otherwise provided by mandatory provisions of applicable law.

15.2. Where the laws of another country, including the GDPR, apply to personal data processing, Measurme processes such personal data in accordance with the relevant legal requirements to the extent that they apply.

15.3. All disputes arising in connection with this Policy will be resolved through negotiation or, if no agreement is reached, in accordance with the procedure established by applicable law.

16.2. Please include your name, contact details, the nature of your request, and information that will help us identify you as a Platform User.

16.3. Measurme reviews personal data processing inquiries within the periods prescribed by applicable law.

16.4. To properly identify an applicant, Measurme may request additional information or documents necessary to verify their identity.

16.5. If an inquiry concerns personal data processed by Measurme solely on behalf of a Professional, Measurme has the right to forward the inquiry to that Professional or suggest that the applicant contact the Professional directly where this is consistent with applicable law.

16.6. If your request concerns personal data processed by a Professional using the Platform, Measurme may interact with that Professional to properly address the request within the scope of its authority.

16.7. If you believe your personal data protection rights have been violated, you have the right to contact the Ukrainian Parliament Commissioner for Human Rights, a court, or another competent authority in accordance with applicable law.
